Terms of Service

These terms apply to your use of famawell.com and to the services Famawell provides. Famawell is a sole proprietorship registered with the Netherlands Chamber of Commerce (KvK) under number 94253269, located at Schapendrift Zuid 21, 3958 WG Amerongen, the Netherlands.
Our services
Famawell provides software and setup services for businesses: websites with search optimization and AI chat assistants, AI voice receptionists, appointment booking, and review requests. We sell to businesses only. The exact scope, price and start date of your service are set out in your order or proposal.
No guaranteed results
We do the work carefully and report honestly on what it does. We do not guarantee search rankings, call volumes, bookings or revenue. Those depend on many things outside our control, including search engines, your market and how your business responds to leads.
Billing and cancellation
Services are billed monthly in advance by card through our payment processor. Your subscription renews each month until you cancel. You can cancel at any time by emailing support@famawell.com; cancellation takes effect at the end of the current billing month, and we do not refund partial months.
When you cancel, a one-time exit fee of $1,000 applies, whether or not you take your website with you. We hand over your website once the exit fee is paid.
Your website
You own the website we build for you, including the content, photos and logos you provide. When you leave, a site built on our HighLevel template is shared to your own HighLevel account as a snapshot, and a custom-built site is transferred to you as its code repository. Services that run on our accounts, such as the AI receptionist, automations and phone numbers, end when your subscription ends.
Your responsibilities
- Give us accurate information about your business, services and service area.
- Make sure you have the right to use any content, logos and photos you send us.
- Use the messaging and calling features in line with applicable laws, including the Telephone Consumer Protection Act and carrier rules. Only message people who have given consent.
SMS program terms
Famawell operates an SMS program to communicate with people who contact us or book a demo.
- What you receive: appointment confirmations and reminders, replies to your questions, and service updates about your Famawell account.
- How you opt in: by checking the SMS consent box on a form on our website, or by texting our number first. Consent to receive text messages is not a condition of any purchase.
- Message frequency varies depending on your appointments and conversations.
- Message and data rates may apply.
- Opt out at any time by replying STOP. You will receive one message confirming you have been unsubscribed, and no further messages after that.
- Help: reply HELP, or email legal@famawell.com.
- Carriers are not liable for delayed or undelivered messages.
We handle your phone number as described in our Privacy Policy. Mobile opt-in data and consent are never shared with third parties for marketing purposes.
Calls and recording
Calls to Famawell numbers, including our demo line, may be answered by an AI assistant and may be recorded and transcribed to provide and improve the service. You are told this at the start of the call. If you do not want the call recorded, please hang up and email us instead.
Website use
The content on this website is for general information. The sample conversations and screens shown on it are illustrations, not records of real customers.
Service availability
We work to keep everything we set up running well, but the services are provided "as is" and we don't guarantee they will be uninterrupted or error-free. We are not responsible for outages or errors caused by third-party platforms we rely on, including HighLevel, phone and SMS carriers, Google and hosting providers.
Liability
We are not liable for indirect or consequential losses, such as lost jobs, lost profits or lost revenue. For anything else, our total liability is limited to the fees you paid us in the one month before the claim arose. Nothing in these terms limits liability that cannot be limited by law, such as for intent or gross negligence.
Governing law
These terms are governed by the laws of the Netherlands. Disputes will be brought before the competent court in the Netherlands, unless mandatory law says otherwise.
Changes
We may update these terms. If a change affects an active subscription, we will tell you by email at least 30 days before it takes effect.
